Asylum
An individual is eligible for asylum if she meets the definition of a refugee. Asylum seekers can file an application within a year of arriving in the U.S (Affirmative Asylum), or they can file it “defensively,” once they are in deportation proceedings (Defensive Asylum). Anyone in the U.S. can claim asylum whether they are here legally or not. An asylum seeker must demonstrate a Well-Founded Fear” of “Persecution” perpetrated by the government or an entity the government can not/will not control “On account of” Race, Religion, Nationality, Political Opinion, Membership in a Particular Social Group.
Refugees
Certain foreign nationals may obtain a status of refugee if they meet the definition of a refugee. A refugee is “any person who is outside any country ... and who is unable or unwilling to return to, and is unable or unwilling to avail himself or herself of the protection of that country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion.” Once refugees resettle in the US, they become eligible for certain benefits and our office can help refugees navigate through the immigration system.
