Family-Based Applications for Permanent Residence
The US immigration laws permit U.S. Citizens and Lawful Permanent Residents to sponsor certain family members. US citizens may be able to sponsor their spouse, unmarried sons and daughters, married sons and daughters, and brothers and sisters for an immigrant visa. This visa also called a K visa allows foreign nationals to obtain a visa for the purpose of entering the U.S. In order to obtain a K-1 fiancé(e) visa, the foreign national and the US citizen fiancé(e) must intend to marry each other within 90 days of entering the U.S. and the foreign national must meet all eligibility requirements.Adjustment of Status
Applicants may apply for their immigrant visa (“Green Card”) from within the U.S., through the United States Citizenship and Immigration Services. Applicants who qualify for an Adjustment of status do not need to leave the United State in other to apply for their Green Card. This process is similar to the adjustment of status except the applicant must apply for their immigrant visa in their home country. In other words, if the applicant already lives in the US, he/she must leave the US and return to his/her home country in order to obtain a visa to reenter the US.B-2 Visitor Entry Visas
The US immigration law requires that individuals who enter the U.S. for a limited time to visit must hold a B-2 visitor visa. Visitor visas are nonimmigrant visas and allow a foreign citizen to travel to a U.S. port of entry and request permission of the U.S. immigration inspector to enter the US. Applicants for visitor visas should generally apply at the nearest U.S. Embassy or Consulate in the country where they live.U.S. Naturalization Applications
Individuals holding lawful permanent residence may apply to become a Naturalized U.S. Citizen after a period of three or five years, provided they meet all other eligibility requirements. To qualify for U.S. citizenship, a permanent resident must be at least 18 years old and demonstrate that are able to communicate in the English language and have knowledge of U.S. civics.Deferred Action for Childhood Arrival Applications
Some foreign nationals who arrived in the U.S. as children and do not have a lawful status may be eligible for Deferred Action. DACA is valid for two years and may be renewed. To qualify for DACA, individuals must have entered the U.S. before the age of 16, meet all other eligibility requirements.Employment Authorization Document Applications
Certain individuals who are in the U.S. in nonimmigrant status may apply for an Employment Authorization Document. This document is issued by USCIS and to allow these individuals to work in the U.S.F-1 and J-1 Student and Exchange visitor Applications
These non-immigrant visas are available to individuals seeking entry to the U.S. to attend a school or participate in J-1 exchange visitor programs. An applicant may obtain an F-Visa or J-visa, provided they are accepted by an authorized school; they have sufficient funds to cover costs for at least 12 months of education; they Intent to return home at end of studies. F-1 and J-1 students are only admitted for the duration of their status.Waiver and Admissibility Issues
Certain individuals who came to the United States without proper inspection, who overstayed their visa, or who have admissibility issues, but who are seeking an immigrant visa, adjustment of status, certain nonimmigrant statuses, or certain other immigration benefits may need to have their admissibility issue resolved first.
